An export declaration is necessary for all shipments valued at more than $2000 CDN or for controlled goods that need an export permit or license.
The requirement to submit a CERS export declaration applies to all destinations except the United States, Puerto Rico and the U.S. Virgin Islands. However, if they are controlled goods, permits and licenses will still be needed.
Controlled goods include weapons, military goods, products of U.S. origin and other items.
All export declarations, commonly called B13s, must be made electronically within the legislated timeframe based on the mode of transportation. For example, for air shipments, the export declaration must be made two hours prior to the loading of the goods on the aircraft.
However, the first step for an exporter is to ensure their business number is activated for export. To do so, the exporter must contact Revenue Canada. Next, they will be asked for information on the products they intend to export and the total value of their annual exports. The exporter will then have to choose to file their B13 export declarations themselves, via the Canadian Export Reporting System (CERS) portal, or to entrust this task to their customs broker or forwarding agent.
Anyone wishing to use the services of an agent must first complete the BSF831 form.
Whichever option you choose, all B13 export declarations must be made electronically within the required timeframes in accordance with the mode of transport. Exporter and consignee information must be transmitted, including cargo and transportation data.
The most prevalent errors made by exporters are failing to file a CERS export declaration for shipments intended for Mexico that transit the United States and failing to obtain a permit to export goods manufactured in the United States. Both omissions will result in a penalty.
